Writ filed seeking enquiry into abuse of power by Raiganj UNO, AC Land

A writ petition has been filed seeking judicial inquiry into alleged abuse of power by the upazila nirbahi officer (UNO) and the assistant commissioner (AC, Land) of Raiganj upazila in Sirajganj.

Lawyer Md Shishir Monir, on behalf of one Md Tauhidul Islam Biswas from Sherpur in Bogura, filed the writ with the High Court, seeking judicial enquiry against Raiganj UNO Md Rajibul Alam and AC Land Subir Kumar Das for sentencing an individual to two months of imprisonment and taking unauthorised actions against two others from the same family.

Besides, the writ also appealed to the court to ensure the safety of the victim and his family.

Secretary of public administration ministry, Rajshahi divisional commissioner, Sirajganj deputy commissioner, Rajshahi superintendent of police, Raiganj UNO Md Rajibul Alam, the AC Land of Raiganj, and the officer-in-charge of Raiganj Police Station have been made defendants in the writ.

Shishir Monir said on 2 December 2020, the writ petitioner's younger brother Ahsan Habib, a university student, had a slight misunderstanding with Raiganj AC (land) Subir Kumar Das at the petitioner's dairy farm. The matter was later settled in the presence of Tariqul Islam, a government college teacher and also another younger brother of the petitioner.

But an hour after the incident, AC (Land) Subir sent 10 policemen from Raiganj police station to the petitioner's house in Sherpur. Police members inquired about the incident and asked Ahsan Habib to go the police station to beg pardon to the AC again, the lawyer also said.

Ahsan agreed to go to the police station. But when the police left the place, they caught Tariqul Islam, another younger brother of the petitioner, and took him to the police station. AC Subir later sentenced Tariqul to two months of imprisonment, administering a mobile court in the upazila, he added.

On the same day, Tariqul was severely beaten on the order of Subir. On the same day, using his administrative power, Raiganj UNO Rajibul sent a letter to Rangpur Carmichael College, police and administration officials urging them to take an action against Tariqul, Monir said.

The UNO sent another letter to the dean and chairman of law faculty and department of Chittagong University, requesting them to take an action against the petitioner's younger brother Ahsan Habib.

Although there is a provision to provide a copy of mobile court's order within five days, it gave its order after 23 days. The family of the applicant has been facing administrative threats since the day of the incident," added lawyer Monir.
