Ctg Money Loan Court summons Pubali Bank’s DGM for negligence of duty

The Chattogram Money Loan Court has summoned the DGM of Pubali Bank and the manager of Agrabad branch for not taking action against defaulter.
Judge Mujahidur Rahman of Chattogram Money Loan Court passed the order as the plaintiff (bank) has not appeared in court on 22 dates since the case was filed in 2015.
According to the court, in 2010, Pubali Bank filed a case against the two proprietors of RJ Fashion in the Chattogram Money Loan Court for Tk1,26,07,120.
The proprietors, Salam Hashemi and Md Moinuddin, was accused in this case filed by the Agrabad branch of the bank. Then the verdict on the money loan case was given in 2015.
In the verdict, the court fined the defandants a total of Tk1,98,99,819 including the bank's current interest and the cost of handling the case.
After 90 working days of the verdict, Pubali Bank filed a case in the same court on June 1, 2015, to be paid the money. Then on September 10, 2015, the court issued a summons to the defendants to appear in court through newspaper.
As the defendants did not appear to the court, the court fixed November 5, 2015, for the bank to take action. But since then, the bank authorities have not appeared in court on the scheduled dates 22 times.
In this situation, the court has directed to show the reasons why disciplinary action should not be taken against the DGM of the Agrabad branch of Pubali Bank for negligence of duty.
Mohammad Ali Amjad, current branch manager of the bank, said, "I have recently joined this branch. The bank has a legal officer and a panel of lawyers to handle the case. Even then, it is very sad that the bank has not appeared in a case for so long. I have received a court notice. I will appear before the court and explain the situation on the fixed date,"
The court expressed, due to such negligence of the bank, the recovery of huge amount of defaulted loans have become uncertain which is an ominous sign for the national economy. Cases filed without a decreed action leads to lengthy litigation, which reduces the right to a speedy trial.
