Sikders’petition dropped from AD cause list

The Appellate Division (AD) on Thursday dropped from the cause list a petition filed by Ron Haque Sikder and his brother Dipu Haque Sikder, seeking cancellation of the High Court order on anticipatory bail. The brothers have been accused of threatening to murder a bank official.

The full bench of the Appellate Division led by Chief Justice Syed Mahmud Hossain passed the order. Now the brothers will not be able to appeal the High Court (HC) order, said Deputy Attorney General Biswajit Debnath.

The brothers applied at the Appellate Division against the HC order and sought permission to file a leave to appeal petition. The hearing on the matter was set for Thursday.

The Appellate Division also dropped another petition of the brothers seeking cancellation of HC observations on filing bail appeal while staying abroad.

Attorney General Mahbubey Alam and Deputy Attorney General Biswajit Debnath represented the state at court.

Previously, the brothers sought anticipatory bail from the HC while staying abroad in an attempted murder case.

On July 20, a HC virtual bench rejected the plea and also fined the brothers 10,000 personal protective equipment for donation to the prime minister's fund as they wasted the time of the court by filing the bail petition illegally.

The brothers on July 28 moved to the Appellate Division seeking permission to appeal the HC's bail plea rejection order.

The HC in its full order of bail appeal rejection for the Sikder brothers said there is no scope for applying for anticipatory bail while staying abroad.

"Such an unprecedented appeal is the first in human history. It is certainly astonishing. Other courts across the globe observed the appeal with surprise and they are startled and dumbfounded by seeing the supreme excellence of our legal system," said the HC.
