HC directs to find fake plaintiff
The court has fixed 8 August for the next order in the case
The High Court (HC) has directed the Crime Investigation Department (CID) to find the fake plaintiff after the hearing of a case filed against a Rafiqul Islam from Jhalakathi.
The HC bench of Justice Mohammad Abu Zafar Siddiqui and Justice KM HafizulAlam stayed the proceedings of the case and directed the CID to file the report within 30 days after finding out the culprits behind the fake case.
The court has fixed 8 August for the next order in the case.
Lawyer Manzil Morshed, who appeared for the plaintiff in the court, said, "A petition was filed against Rafiqul Islam of Rajapur of Jhalakathi Police Station with the Dhaka Metropolitan Magistrate's Court under Section 420/406/506 of the Penal Code by a fake plaintiff named Zakir Hossain."
Rafiqul was later arrested in the case and sent to jail. After spending seven days in jail, he was released on bail. He started searching for the plaintiff according to his address but discovered that the person and address did not exist. At the same time, he came to know that some people had filed the case due to business animosity, lawyer Manzil added.
Then, an application was filed in the court to take action through an investigation regarding the matter. However, only the address of the plaintiff was ordered to be verified. The police report stated that the address did not exist.
Finding no other way to find those involved in the case, Rafiqul Islam appealed to the HC. The court ordered the hearing of the application along with the rules.
